| 520 | |a In the first part, the article deals with the necessary distinction between the medical, cultural and social aspects of physical and mental handicap, and the consequent shift from an understanding of physical and mental handicap oriented towards disability to one that focuses on positive abilities. The Annex to the international document of the World Health Organization and the UN Convention on Handicaps of 2008 emphasized that the law on the social inclusion of handicapped people should be approached within a universal understanding of human development and human rights. The second part asks why the human rights of handicapped people are not adequately considered in influential statements in philosophical ethics (classical Utilitarianism, Preference Utilitarianism, contractual theories and ideas of autonomy) and adequately grounded in the face of the demand for a juridical ethic of universal benevolence that is close to the Christian commandment to love one’s neighbour and to a form of care that is not patronising. The third part discusses the standing and limits of theological attempts to answer the question about the meaning of physical evil such as illness, grief and handicaps. This reflection exposes the presuppositions under which bodily phenomena and mental impairments can be assigned in this threefold group, understood as elements of a contingent creation, while rejecting the classical theological interpretation of original sin. | ||
| 520 | |a L’article étudie en première partie la nécessaire distinction entre les aspects médicaux, culturels et sociaux du handicap et le changement d’approche qui y est lié, qui fait passer la compréhension des handicaps physiques ou intellectuels centrée sur le manque à une compréhension qui prend en compte les ressources des personnes concernées. L’annexe d’un document international provenant de l’Organisation Mondiale de la Santé et de la Convention des Nations Unies, a mis en évidence l’importance du droit à une intégration sociale pour les personnes handicapées, ceci dans le cadre d’une compréhension universelle de la dignité et des droits de l’homme. La deuxième partie de l’article, pose la question de savoir pourquoi les droits des personnes handicapées ne sont pas pris suffisamment en considération dans les fondements de l’influente éthique philosophique contemporaine (l’utilitarisme classique et l’utilitarisme des préférences, les théories contractuelles et les conceptions fondées sur l’autonomie) et motive au contraire, l’exigence d’une éthique de la bienveillance universelle, qui est proche du message chrétien de l’amour du prochain et ne conduit pas à une forme d’assistanat a priori. La troisième partie de l’article évoque la pertinence et la limite des tentatives de réponses théologiques à la question du sens du mal physique comme la maladie, la souffrance et le handicap. Ces réflexions précisent sous quelles conditions le phénomène des atteintes physiques ou intellectuelles peut être rattaché à ces trois catégories et les interprètent comme des composantes d’une création contingente, alors que l’interprétation classique du péché originel est récusée. | ||
