| 520 | |a In der gegenwärtigen Debatte um eine angemessene Begründung allgemeiner Menschenrechte lassen sich vereinfacht die Lager der Begründungsuniversalisten und der Begründungspartikularisten unterscheiden. Begründungsuniversalisten gehen davon aus, dass eine erfolgreiche erteidigung der universalen Geltung der Menschenrechte zwingend auf eine universale, d.h. allgemein einsichtige Begründung der Menschenrechte angewiesen ist, weshalb religiöse Begründungen nicht hinreichend sind. Begründungspartikularisten hingegen halten eine Überlappung von Begründungen aus verschiedenen Religionen und Weltanschauungen für hinreichend. Der vorliegende Beitrag rekonstruiert zunächst eine argumentative Pattsituation, da beide Seiten überzeugende Argumente für ihre Sicht vorbringen können. Als Ausweg aus dieser Pattsituation entwickelt der Text eine Theorie des schwachen Universalismus. Dieser nimmt die berechtigten Anliegen beider Seiten auf und bahnt einen Mittelweg zwischen der Notwendigkeit einer universalen Begründung einerseits und der Notwendigkeit einer Sensibilität für partikulare Umsetzungskontexte andererseits. | ||
| 520 | |a In the contemporary debates on the appropriate justification of human rights, it is possible to distinguish between universalistic and particularistic approaches. Universalistic approaches assume that a successful defense of the universal validity of human rights must imply a universal, i.e. generally acceptable justification of them. Thus, religious justifications fall short of being sufficient justifications of human rights. Particularist approaches, on the other hand, regard an overlapping consensus of diverse religious justifications as sufficient legitimation of human rights. This article first reconstructs an argumentative deadlock between both sides, as both can allege convincing reasons for their respective view. In order to overcome this deadlock, the article develops an approach ofweak universalism in a second step. Weak universalism integrates the legitimate insights of both approaches and steers a middle course between the necessity of a universal justification of human rights on the one hand and the necessity of a certain sensibility for the particular modes of implementation on the other hand. | ||
