AB In tema di ‘fondamenti’ del Diritto canonico si è spesso fatto riferimento ad istanze di preteso stampo teologico, trascurando del tutto quello che – invece – il Legislatore ecclesiale aveva affermato (ed eventualmente disposto) in occasione delle Promulgazioni di natura generale del Diritto canonico stesso: dal Liber Extra al CCEO. Lo studio ripercorre i testi delle costituzioni apostoliche di promulgazione, dalla Rex Pacificus del 1234 alla Sacri Canones del 1990, evidenziando ‘che cosa sia’ secondo il Legislatore stesso, il Diritto canonico, prima ed oltre ogni narrativa dottrinale.
AB Often, about the ‘foundations’ of canon law, statements of an alleged theological nature are referenced, completely ignoring what the ecclesial Legislator affirmed (and possibly adjudicated) during the general Promulgations of canon law itself: from Liber Extra to CCEO. This essay traces the texts of the apostolic constitutions that promulgated canonical norms, from the 1234 Rex Pacificus to the 1990 Sacri Canones, highlighting ‘what canon law is’, according to the legislator himself, before and beyond any doctrinal teaching.
