Zusammenfassung: | In a work on uṣūl al-fiqh Faḫraddīn ar-Rāzī (d. 606/1210) preserves a number of fragments from Naẓẓām’s (d. ca. 230/845) K. al-Nakṯ which had been used by Ǧāḥiẓ (d. 255/869) in a juridical context (his K. al-Futyā); most of them were hitherto unknown. Their intention was to show that the Companions of the Prophet and the tābiʿūn did not follow a common line but rather disagreed among each other. In their context they were meant to build up rational resistance against the principles of the aṣḥāb al-ḥadīṯ; they permit therefore interesting glimpses into the early stage of prophetical tradition and juridical development. |
