| Summary: | The grounds established in the formulation of the doubt affect the decision rendered in both first and second instance. If grounds are formulated subordinately, this opens the possibility that the second instance judges could confirm a first instance affirmative decision by reason of the subordinate ground should they be able to argue for equivalent conformity. This study explores how subordinate grounds work, as well as how equivalent conformity works. Les motifs établis dans la formulation du doute ont une incidence sur la décision rendue tant en première qu'en deuxième instance. Si les motifs sont formulés de façon subordonnée, cela ouvre la possibilité que les juges en deuxième instance, pour peu qu'ils soient en mesure d'alléguer une conformité équivalente, puissent confirmer une décision affirmative de première instance pour cause de motif subordonné. L'étude traite aussi de la façon dont opèrent et les motifs subordonnés et la conformité équivalente. |
