Description
Summary:This paper explores the nature of the "tribunale limitrofo" outlined in Article 24 § 1 of the instruction Dignitas Connubii in terms of both procedural theory and the praxis of the ecclesiastical courts. After an analysis of this tribunal's distinctive characteristics, the author suggests a change of approacch: from the merely descriptive one used in DC to a more convincing essentialist and structural model (that of the subsidiary tribunal), which indicates from the start the central principle of the hypothesis and makes clearer the precise nature of the function carried out by this "nearby tribunal"
