| Riepilogo: | The article inquires into a series of positions, doctrines and campaigns launched by 13th and 14th century Franciscan writers that have not stopped playing an important role since the process of « legalization » (Verrechtlichung) to which Western society had been subjected; the history of the relationship between legal and scientific (e. g. theological) disciplines (as between John XXII and Ockham); the advent of a society no longer «master in its own house» (Freud); some difficulties in thinking the relation between Franciscan poverty and «abdicatio» and the contribution of Franciscans to the growth of law and economy. L’articolo prende in considerazione una serie di posizioni, dottrine e tendenze inaugurate dai francescani dei secoli tredicesimo e quattordicesimo, tra cui rientrano: il processo di graduale «legalizzazione» attraversato dalla società occidentale; la storia del rapporto fra teologi (come Guglielmo d’Occam) e giuristi (come il suo antagonista, Papa Giovanni XXII); l’emergere di una società non più «maestra nella sua propria casa» (Freud); alcune difficoltà nel pensare il rapporto fra povertà francescana e «abdicatio» e il ruolo giocato dai francescani nello sviluppo dell’economia e del diritto. |
