| Zusammenfassung: | Pope Francis called an Extraordinary General Assembly of the Synod of Bishops on topics related to the Christian family and the challenges of evangelization in these early years of the 21st Century. On the occasion of its celebration, the author points out the absence of a real family law on the Code of Canon Law, as well as the right-duty of Christian families to evangelization. He offers some reflections on several canonical questions that may help to solve some difficulties related to failed marriages, such as the preparation and admission to canonical celebration of marriage, the identification contract-sacrament, the presumption of c.1060, the proof of matrimonial nullity and the need to increase procedural celerity in the matrimonial nullity cases, among others. El Papa Francisco ha convocado un Sínodo de los Obispos sobre la situación de la familia cristiana y los desafíos a los que debe enfrentarse en este comienzo del siglo XXI. Con ocasión de esta convocatoria, el autor, tras señalar la ausencia de un verdadero derecho de familia en el Código de Derecho Canónico y el derecho-deber evangelizador de la familia cristiana, reflexiona sobre algunas cuestiones canónicas que podrían contribuir a solucionar algunas situaciones matrimoniales conflictivas, entre las que se encuentran la preparación y admisión al matrimonio canónico, la identidad contrato-sacramento, la aplicación del c.1060 en casos de validez dudosa del matrimonio, la prueba de la nulidad y la agilización de los procesos para declararla, etc. |
