Summary: | One of the novelties in the 2015 reform of the processes governing the nullity of canonical marriage is the introduction of an abbreviated matrimonial process before the diocesan bishop. This paper studies the circumstances of people and phenomena that evince marriage nullity (new canon 1683, 2nd), by providing a detailed analysis of the circumstances which, by way of example, are mentioned in article 14 § 1 of the Rules of Procedure accompanying the reform of canons 1671 to 1691. The author notes the reservations expressed in relation to such circumstances (as currently drafted) from technical-legal perspectives, especially in light of how they have been explained in the Sussidio applicativo issued by the Roman Rota. Finally, the paper concludes with a recommendation that the Pontifical Council for the Interpretation of Legislative Texts contribute to clarifying the meaning of the law and facilitate its proper application by judges. |
