| Résumé: | Spätestens mit den Reformen der „Agenda 2010" wurde der bundesdeutsche Sozialstaat in Richtung einer Neuen Fürsoglichkeit umgebaut; dabei wurden auch die Gerechtigkeitserwartungen an den Sozialstaat neu justiert. Im Zuge von „Fordern und Fördern" ist der Sozialstaat gegenüber Leistungsbezieherinnen in vielen Fällen unbarmherzig geworden. Diese Unbarmherzigkeit ergibt sich im Vollzug der von ihm erwarteten Gerechtigkeit. In der Kritik am aktivierenden Sozialstaat wird eine Alternative zu dessen kalter, weil erbarmungsloser Gerechtigkeit gesucht. Gefunden wird sie in den berechtigten Ansprüchen von Einzelnen auf eine angemessene, d. h. ihren besonderen Bedarfs- und Problemlagen entsprechende Förderung - und auf die dazu notwendigen Freiräume für eine jeweils ihnen geschuldete Barmherzigkeit. At the latest with the reforms of the „Agenda 2010", the welfare state of the Federal Republic of Germany was altered in the direction of a New Solicitude; in the process the justice-related expectations with respect to the welfare state were also readjusted. In the course of „demanding and supporting," the welfare state has become, in many instances, merciless towards the recipients of the benefits. This mercilessness results in the administration of the justice expected by the state. In the criticism of the activating welfare state, an alternative to the cold justice caused by its mercilessness is being sought. lt is being found in the legitimate demands of individuals for appropriate support, i.e. support corresponding to the particular circumstances of their needs and problems, and in their demands for the free spaces this requires for a mercy that is due to each of them. |
