Summary: | In the cases of marriage separation and civil divorce, the legal authority and the care and the shared custody of the children is frequently controversial and it entails the canonical regulation about the catholic education of the children and their preparation to receive the sacraments of the Christian initiative. A synthesis of the Spanish civil doctrine and jurisprudence is put forward and the reasons to prefer certain judicial options are given, ever bearing in mind the children’s good. Additionally the canonical regulation to be borne in mind is referred to. En los casos de separación matrimonial y divorcio civil, la patria potestad y la guarda y custodia compartida de los hijos es frecuentemente conflictiva y en ella queda implicada la normativa canónica sobre la educación católica de los hijos y su preparación para la recepción de los sacramentos de la iniciativa cristiana. Se expone una síntesis de la doctrina y jurisprudencia civil española y se aducen las razones para preferir determinadas opciones judiciales, teniendo en cuenta siempre el bien de los hijos. Complementariamente se hace referencia a la normativa canónica que deberá tenerse en cuenta. |
