| Summary: | Determinare l'identità di una persona e le sue prerogative nella Chiesa è un'operazione essenziale non solo per chi ha il compito di guidare una comunità ecclesiale, ma anche per il soggetto stesso che deve essere consapevole del suo compito. Per poter affrontare questa problematica la scienza giuridica ricorre al concetto di "status". Esso si riferisce alla capacità acquisita stabilmente da una persona mediante un atto sacramentale (Battesimo, Cresima, Ordine sacro, Matrimonio) o non sacramentale (voti o vincoli sacri), ma anche quelli acquisiti per compiere un incarico come un Ufficio ecclesiastico con potestà di governo (cfr. can. 145) o mediante una delega (cfr. can. 131 § 1) e che possono essere chiamati "statuto di funzione". Il presente studio, presenta l'utilizzazione di tale concetto dal Diritto romano e nel progresso storico della Chiesa fino ai dibattiti post-conciliari e nell'attuale legislazione. Tale concetto può essere usato anche parlando di oggetti e istituzioni, in quanto soggetti a particolari norme che ne disciplinano il loro utilizzo e organizzazione. Defining a person's identity and his or her prerogatives inside the Church is essential not only for those who are responsible for leading an ecclesial community, but also for the individual itself who has to be conscious of his or her function. Legal science uses the concept of "status" to deal with this issue. The "status" refers to the ability acquired in a stable manner through a sacramentai (Baptism, Confirmation, Order, Matrimony) or non sacramentai action (vows or sacred bonds) and to those abilities acquired in order to fulfill a function such as an ecclesiastical office with power of governance (see CIC can. 145) or by delegation (see CIC can. 131 § 1) and which can be called "statute of function". This research shows the use of this concept in the Roman Law and throughout the historical progress of the Church up to the post-conciliar debates and the present legislation. The same notion can be used also to talk about objects and institutions, as they are subject to specific rules regulating their usage and organization. |
