A partire dalla ricostruzione dei motivi (di carattere canonico e di derivazione civile, in particolare l'introduzione del Regolamento generale sulla protezione dei dati a livello europeo) per cui si è addivenuti a una nuova normativa canonica, lo studio evidenzia cinque contesti di confront tra i due decreti: l'ambito di applicazione; le condizioni per la liceità del trattamento dei dati; le figure di responsabilità; I diritti dell'interessato; la vigilanza, il controllo e le sanzioni. Viene quindi messa in luce la diversa prospettiva con cui i due decreti si rapportano alla realtà ecclesiale, al fine di salvaguardarne la peculiarità, lasciando trasparire linee di ulteriore possibile sviluppo. | ||

Starting from the reconstruction of the reasons (of a canonical and civil nature, particularly the introduction of the General Regulation on data protection at European level) for which a new canonical regulation has been adopted, the study highlights five contexts of comparison between the two decrees: the scope of application; the conditions for the lawfulness of data processing; the figures of responsibility the rights of the data subject; supervision, control and sanctions. The different perspective with which the two decrees relate to the ecclesial reality is therefore highlighted, in order to safeguard their peculiarity, allowing lines of further possible development to emerge. | ||
